Special Rules for Ordering and Purchase

The purchase procedure consists of the ordering phase and the purchase phase.

Prices of photographs are expressed in the currency convertible mark (KM), including tax obligations for the Content Recipient. The photograph is the subject of purchase at the price that was valid at the moment when the purchase was made via the electronic purchase form. 

Difference between Media and Commercial Use

Media use implies any informing and educating of the public. This includes publications in electronic and print media, as well as posts on social networks and websites of organizations and institutions. Media use does not include promotional posts in media, which aim to promote and sell a specific product or service.

Commercial use is the use of photographs by private entities for the purpose of advertising and/or selling a specific product or service.

Citing the Source and Author

Clients who use photographs purchased on the "Foto baza" platform for media purposes are obligated to cite the author's name and the "Foto baza" page with each publication. This information must be stated below the photograph in the form "First Name Last Name - Fotobaza.ba". Commercial clients do not have the obligation to cite the source. All clients may use the purchased photograph only once, on one platform, exclusively for the purpose specified at the time of purchase.

Ordering

The photograph is ordered electronically, via the appropriate form, by clicking on a specific photograph after which the type of use of the photograph is determined and it is added to the cart. Ordered photographs are in the cart, and by clicking on the "Proceed to Purchase" form, a new form opens where the photograph purchase is conducted.

Purchase

The photograph is considered purchased after filling in the required data on the invoice form, selecting the payment method via one of the offered payment cards, accepting the purchase conditions, and pressing the "Buy" form. After pressing the "Buy" form, the photograph is considered purchased and there is a transfer of the corresponding funds from the payment card in accordance with these Purchase Conditions and the General Terms of Business of "Foto baza".

Payment

Payments for the purchased photograph will be made in convertible marks. 

Online payment can be made with Visa, Maestro, and Mastercard payment cards. When charging the payment card used for paying for the photograph, the amount indicated on "Foto baza" is converted to your local currency according to the exchange rate applied by banks/payment card operators, which may result in a difference in the amount charged to the Content Recipient's card compared to the price stated on "Foto baza".

Security of Payment with Payment Cards

The confidentiality of your data is protected and secured by using TLS encryption. Pages for internet payment are secured using Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is the process of encrypting data to prevent unauthorized access during their transmission. This enables secure transfer of information and prevents unauthorized access to data during communication between the user's computer and the WebPay service, and vice versa. 

The WebPay service and financial institutions exchange data using a virtual private network (VPN), which is protected from unauthorized access. 

Monri Payment Gateway is certified according to the PCI DSS Level 1 security standard prescribed by Visa and Mastercard rules. 

The merchant does not store payment card numbers and the numbers are not available to unauthorized persons.

Statement on Protection and Collection of Personal Data 

We undertake to provide protection of customers' personal data, by collecting only necessary, basic data about customers / users that are essential for fulfilling our obligations; we inform customers about the way collected data is used, regularly give customers the option to choose about the use of their data, including the decision whether or not they want their name removed from lists used for marketing campaigns. 

All user data is strictly kept and available only to employees who need this data to perform their job. All our employees and business partners are responsible for respecting the principles of privacy protection.

Delivery

Fotobaza.ba undertakes to enable the Content Recipient to download the photograph, no later than within 5 (five) days from the day it receives confirmation approving the online transaction. Fotobaza.ba undertakes to send a notification exclusively in the form of email that the Content Recipient has purchased the photograph and can download it immediately. The purchased photograph can be used only once. In the case of media, this means one publication in one medium and one sharing on social networks belonging to that medium.

Complaint

Fotobaza.ba undertakes to enable the download of a photograph that is technically correct and corresponds to the description stated on www.Fotobaza.ba. The image on the website www.Fotobaza.ba does not have to correspond to the actual appearance, and the Content Recipient cannot complain about this segment. 

If the Content Recipient is unable to download due to technical problems caused on the Fotobaza.ba server, Fotobaza.ba undertakes to provide a new opportunity to download the photograph, for which the Content Recipient bears no costs. 

In the event that the Content Recipient is still unable to download caused by technical problems on the Fotobaza.ba server, the Content Recipient is obligated to contact Fotobaza.ba, which will offer an adequate solution that will not include any compensation or further costs from the Content Recipient. The Content Recipient has no right to request a refund in this situation. 

In the event that the Content Recipient cannot download the photograph, and the technical problems are not related to Fotobaza.ba, but are caused by the Content Recipient, operator, or third party, Fotobaza.ba bears no responsibility and is not obligated to enable the Content Recipient to download without compensation. 

The Content Recipient is obligated to download the photograph within 30 calendar days, after which they will no longer be able to download the photograph regardless of having made the payment. In this case, the Content Recipient waives any complaint. 

By pressing the "Buy" option, you accept these special rules for ordering and purchasing, which constitute an addition to the General Terms of Business of Fotobaza.
